Terms of Use

These terms are the agreement between you and Troy Thomas for your use of the Patchwork app. They keep things fair and clear. Please read them. By using Patchwork, you agree to them.

The short version

You own the patterns and designs you create. We don't claim them.
Patchwork is free to use. Patchwork Pro is an optional one-time purchase, with no subscription.
Purchases and refunds are handled by Apple.
The App is provided "as is," and our liability is limited.

1. Agreement to these terms

These Terms of Use ("Terms") govern your access to and use of the Patchwork app and this website page (together, "the App"), provided by Troy Thomas ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.

2. Eligibility

You must be old enough to form a binding contract and to maintain an Apple account in your jurisdiction. If you are a minor, you may use the App only with the involvement and consent of a parent or guardian, who is responsible for any purchases.

3. License to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, for your own crafting and personal or professional pattern-making, in accordance with these Terms and the App Store's Licensed Application End User License Agreement ("Apple's Standard EULA"). Where these Terms and Apple's Standard EULA differ, these Terms govern your relationship with us, except where Apple's EULA is required to control.

4. Your content and your patterns

You keep all rights to the patterns, palettes, designs, and projects you create in the App ("Your Content"). We do not claim ownership of Your Content and we do not gain any license to use, display, or distribute it. You are responsible for Your Content, including making sure you have the rights to any images you import (for example, photos you turn into patterns) and that your use doesn't infringe anyone else's rights.

5. Acceptable use

You agree not to:

copy, modify, reverse engineer, decompile, or attempt to extract the source code of the App, except where the law expressly permits it;
resell, rent, sublicense, or redistribute the App itself;
use the App to break the law or to infringe anyone's intellectual property or privacy;
interfere with or disrupt the App's security or intended operation, or attempt to bypass purchase or entitlement checks.

6. Patchwork Pro, purchases, and billing

The App is free to download and includes core features. Some features require Patchwork Pro, a one-time in-app purchase that unlocks all Pro features for the supported lifetime of the App, priced at $19.99 (or your local equivalent).

Patchwork Pro is a single charge with no subscription and no recurring billing. The App has no auto-renewing purchases.

All purchases are processed by Apple through the App Store. Payment is charged to your Apple account at confirmation of purchase. Prices may change for future purchases; any change will not affect a purchase you've already made. You can restore your purchase on a new device using the App's restore option, subject to Apple's rules.

Refunds: Because purchases are handled by Apple, refund requests are managed by Apple under its policies. We generally cannot issue refunds directly. You can request a refund through Apple at reportaproblem.apple.com.

7. Our intellectual property

The App itself, including its name, design, code, user interface, color catalogs, icons, and other materials we provide (but excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. These Terms don't transfer any of those rights to you beyond the limited license above.

8. Third-party services

The App uses services provided by Apple (such as iCloud and the App Store). Your use of those services is also governed by Apple's terms and policies. We're not responsible for third-party services we don't control.

9. Updates and availability

We may update, change, or discontinue features of the App over time to improve it, fix issues, or keep it compatible with new versions of iOS. We don't guarantee the App will always be available, uninterrupted, or error-free.

10. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will meet your requirements, that pattern conversions or imports will be perfectly accurate, or that the App will be error-free or uninterrupted. Some jurisdictions don't allow certain disclaimers, so some of the above may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or content, arising out of or relating to your use of (or inability to use) the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the twelve months before the claim, or 50 USD, whichever is greater. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your infringement of any third party's rights through Your Content.

13. Termination

You may stop using the App and delete it at any time. We may suspend or end your license to the App if you materially breach these Terms. Sections that by their nature should survive termination, such as intellectual property, disclaimers, limitation of liability, and indemnification, will continue to apply.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in San Diego County, California will have jurisdiction over any dispute that isn't subject to small-claims court, and you may always bring an eligible claim in small-claims court. Nothing here limits any non-waivable consumer rights you have under the law of your home country.

15. Apple App Store terms

These Terms are between you and us, not with Apple, and Apple is not responsible for the App or its content. You and we acknowledge that:

Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the App.
Apple is not responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to meet a legal requirement, and claims under consumer-protection or similar laws.
Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App infringes intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government restricted-parties list.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

16. Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date and post the new version on this page. If you keep using the App after changes take effect, you accept the updated Terms.
